Article 1 – General Information
These general terms and conditions of sale are made between Yasmina Schoueri, a practitioner of energy healing, energy healing massage, and a yoga teacher, and any person wishing to make an appointment with her for these services (referred to as “the Client”). By doing so, the Client agrees to accept all of these terms and conditions without reservation and confirms their capacity to enter into a contract with the seller.
Yasmina Schoueri operates in her healing spaces located at 6 Rue Cyrano de Bergerac, 75018 Paris, and 55 Rue Meslay, 75003 Paris, as well as offering home visits. She is registered with URSSAF under the SIRET number 85271086200024.
As a result, placing an order for a service offered by a client, either in person, by phone, by email, or through the website yasminaschoueri.com, implies the Client’s acceptance of these terms and conditions unless otherwise agreed in writing between the parties.
Yasmina Schoueri reserves the right to modify these terms and conditions at any time. The applicable terms and conditions for an order are those in effect at the time the order is placed. Any modifications will only apply to orders placed after the change, not to previous orders.
Any document other than these terms and conditions (such as advertisements, brochures, flyers, etc.) is only for informational purposes regarding the services offered by Yasmina Schoueri and is not contractual.
Article 2 – Definitions
The services offered are those listed on Yasmina Schoueri’s website (yasminaschoueri.com), including:
– Energy healing, energy healing massage, and yoga
– Gift cards for these services
– Booking of these services
The client is the person who books a session or purchases a gift card from Yasmina Schoueri. The beneficiary is the person receiving the treatment.
Article 3 – Conditions for Service Delivery
The purpose of Yasmina Schoueri’s activity is solely the well-being of the individual. According to current legislation, the treatments offered by Yasmina do not involve any medical diagnosis or therapeutic treatment. They are purely techniques for relaxation and well-being. Any erotic or sexual services are strictly excluded from Yasmina Schoueri’s practice. An underwear is mandatory; no nude massage will be provided. Any inappropriate behavior towards Yasmina will be subject to legal action.
Yasmina operates by appointment only at her healing spaces. She can occasionally travel within a 10 km radius from her home for client appointments, in professional settings, or at public venues (events, fairs, conferences, etc.) upon acceptance of a quote by the client. In such cases, the client must provide a space (minimum 10 m²) that meets hygiene, quietness, and safety standards for the treatment.
Services are offered during the hours indicated on the homepage of yasminaschoueri.com. Yasmina Schoueri reserves the right to change the schedule at any time.
During sessions, Yasmina will provide all necessary professional equipment (massage table, protective linens, towels, massage oils, background music, etc.) and reserves the right to refuse a session if the client’s hygiene is questionable and/or if the behavior is inappropriate.
The session begins with a discussion between Yasmina and the client to assess the client’s condition and needs in order to determine the most suitable service. Time will be given for the client to settle in, ensuring their comfort and modesty with sheets and towels.
At the end of the session, time will be allowed for the client to regain their composure and get dressed if necessary. A mutual feedback discussion may occur, and some advice may be given.
Sessions include care, setup, treatment, and concluding discussion.
Article 4 – Contraindications to Treatments
When performed by a qualified professional, treatment is generally safe and beneficial. However, in the case of illness or uncertainty, clients are advised to seek medical advice. Certain total, local, or temporary contraindications exist for treatment, and some conditions require precautions to be taken by Yasmina Schoueri.
In all cases, areas with varicose veins, burns, open wounds, or any signs of inflammation or local infection will not be treated.
Contraindications include:
– Fever, infectious, or contagious conditions
– Hemophilia
– Phlebitis
– Severe untreated hypertension
– Acute pain, inflammation, or injury
– Surgical operation within the last three months
– Intoxication
Precautions to take include:
– Pregnancy: medical advice is recommended if issues arise during pregnancy
– Cancer, heart conditions, any systemic, chronic, or autoimmune disease: a written medical opinion outlining necessary precautions is required
– In case of allergies, anticoagulant treatment, and/or breastfeeding, inform Yasmina
In the event of contraindications, the client must inform Yasmina during the first appointment and at subsequent appointments for any changes in their health status.
Yasmina reserves the right to refuse service to any client whose health condition is incompatible with treatment without prior medical advice.
Article 5 – Financial Conditions
The prices for services offered are listed in euros on yasminaschoueri.com. Prices are fixed and definitive, excluding promotional actions.
Yasmina Schoueri is not subject to Value Added Tax (VAT) according to Article 293B of the General Tax Code; therefore, prices indicated on the website do not include VAT. If Yasmina becomes subject to VAT, prices on the site will be adjusted accordingly for any orders placed after that date.
Yasmina Schoueri also reserves the right to change her prices at any time, with the understanding that services will be billed based on the prices in effect at the time of booking or purchasing a gift card.
Article 6 – Appointment Booking Procedures
6.1. Booking an Appointment
Appointments can be made through the website, in person, by email, or by phone. All necessary contact details for booking are available on yasminaschoueri.com, including an online booking form.
Online bookings are only available for sessions at her healing spaces. For home visits, reservations must be made in person, by email, or by phone.
To book online, the client must complete the booking form step by step, selecting the desired treatment, duration, and availability. Based on the criteria defined, available time slots will be offered. The client finalizes their booking by providing their contact details.
An appointment is only considered valid upon receipt of a confirmation email.
To manage Yasmina Schoueri’s schedule, appointments can be made up to 12 hours before the desired time.
6.2. Modification and Cancellation Conditions
Clients can modify their booking free of charge up to 12 hours before the appointment, in person, by email, or by phone. No modifications will be made within 12 hours before the service; the session will be considered due.
Clients can cancel their reservation up to 12 hours before the appointment using the cancellation link in the confirmation or reminder email, in person, by email, or by phone. Clients cannot cancel within 12 hours of the appointment (except in cases of force majeure). The service will be considered due. An invoice will be issued for any reservation. This clause also applies if the client fails to show up on the day of the session.
6.3. Payment
For appointments, payment is made on-site in cash, by credit card, Lydia, or PayLib at the end of the session. A payment terminal will be available.
6.4. Handling Delays
Yasmina schedules appointments to avoid delays. Time is allocated between bookings to ensure the next client is welcomed properly.
Clients are requested to arrive at the scheduled time. If a client arrives early, the healing space may not be ready; if late, the session will be shortened to avoid delaying subsequent clients. Yasmina Schoueri reserves the right to refuse service if a client is excessively late for a full and proper session. The session will be considered due.
Article 7 – Specific Terms for Packages
Packages are personal, non-transferable, and are not eligible for refunds or extensions of validity, except if Yasmina Schoueri cannot provide the service or for medical reasons (with proof). The expiration date for packages will be clearly stated at the time of purchase.
Article 8 – Gift Card Purchases
8.1. Purchase of Gift Cards
Gift cards can be purchased directly from Yasmina. The client can choose from all her services. A gift card in PDF format will be sent to the client. Payment can be made in cash, by credit card, Lydia, or PayLib.
PDF gift cards are sent within a maximum of 24 hours to the email provided at the time of ordering. A 14-day withdrawal period is provided from the receipt of the client’s payment without justification or penalty.
Yasmina Schoueri will refund the amounts paid by the client within a maximum of 30 days from the receipt of the refund request.
8.2. Terms of Gift Cards
All gift cards are personal and non-transferable.
Unless stated otherwise, gift cards are valid for one year from the date of purchase. They are not eligible for refunds or extensions of validity, except if Yasmina Schoueri cannot provide the service or for medical reasons (with proof).
Reservations can be made in person, by email, or by phone. The gift card must be presented at the beginning of the session.
The modification or cancellation terms for a reservation are the same as those defined in Article 6 of these terms and conditions.
Article 9 – Preferred Rates
Discounts offered in promotional advertisements apply to the normal rate and not to any current promotional rate. They are valid according to the conditions of the promotions offered.
Article 10 – Services Requiring a Customized Quote (Businesses, Events)
Quotes are valid for 30 days from the date of issuance.
The signed quote and terms and conditions represent an agreement and order confirmation. The signed quote and terms must be accompanied by a deposit of 30% of the total amount indicated on the quote. This deposit can be paid in cash, by credit card, Lydia, PayLib, or bank transfer.
Unless an additional payment deadline is agreed upon between the parties and indicated on the invoice, the remaining payment must be made in full within a maximum of 7 working days from the invoice date, in cash, by credit card, Lydia, PayLib, or bank transfer. In case of late payment, a penalty of 15% of the invoice amount will be charged for each month of delay, starting from the day after the payment deadline, without the need for a reminder.
Any request for postponement or cancellation by the client must be sent to Yasmina Schoueri at least 7 working days before the scheduled date. Otherwise, Yasmina Schoueri will be entitled to charge 50% of the total invoice amount as compensation, before deducting the deposit received.
If cancellation occurs within 3 working days before the scheduled date, Yasmina Schoueri will be entitled to charge 75% of the total invoice amount as compensation, before deducting the deposit received.
In case of last-minute cancellation or cancellation the day before, the penalty will be 100% of the scheduled service amount.
If Yasmina Schoueri cancels and no replacement date is agreed upon, she will refund the deposit received within a maximum of 8 days.
Article 11 – Inability to Work
In the event of a temporary physical inability due to illness or accident of Yasmina, she reserves the right to schedule new intervention dates in consultation with the client without any indemnity claim from the client. In the case of a permanent physical inability of the practitioner, all contracts or commitments with Yasmina Schoueri’s clients will be automatically terminated without any compensation claim against Yasmina. Deposits received will be refunded to the client within a maximum of 8 days following the termination of the contract.
Article 12 – Applicable Law and Jurisdiction
These terms and conditions are governed by French law. In case of disputes, the parties agree to seek an amicable solution before any legal action. Failing that, any dispute arising with a client will be subject to the exclusive jurisdiction of the courts of France.
Article 13 – Civil and Professional Liability
It is specified that Yasmina Schoueri cannot be held liable for damages resulting from a client’s negligence, particularly if the client has not disclosed contraindications affecting them during the initial session’s discussion or at subsequent appointments in case of changes in their health status – see all contraindications in Article 4.
