Article 1 – General Provisions

These GTC are entered into by and between Yasmina Schoueri, a practitioner of Akashic Readings (for individuals, businesses, and animal companions), Energy Healing, Energy Massage, and Yoga Instructor, and any individual or legal entity wishing to schedule an appointment for these service provisions (hereinafter referred to as “the Client”). By doing so, the Client represents and warrants that they unconditionally accept the entirety of these General Terms and Conditions of Sale (hereinafter referred to as “GTC”) and possess the legal capacity to enter into a binding contract with the Seller.

Yasmina Schoueri, registered with URSSAF under SIRET number 85271086200024, operates from her healing spaces located at 6 rue Cyrano de Bergerac, 75018 Paris, and 13 Rue Saint-Nicolas, 75012 Paris, and also provides services at the Client’s domicile.

Consequently, the placement of an order by a Client for any offered service, whether in person, by telephone, by email, or via the website [yasminaschoueri.com], shall constitute the Client’s full and unreserved agreement to and acceptance of these GTC, unless a specific agreement has been previously concluded in writing between the Parties.

Yasmina Schoueri reserves the right to amend these GTC at any time. The GTC applicable to an order shall be those in force at the time the order is placed. In the event of any amendments, the amended GTC shall only apply to orders placed after the date of such amendment and not to prior orders.

Any document other than these GTC (including, but not limited to, advertisements, prospectuses, flyers) is for informational purposes only regarding the activity offered by Yasmina Schoueri and shall not be considered contractually binding.

Article 2 – Definitions

For the purposes of these GTC, the following terms shall have the meanings ascribed to them below:

Services: Refers to all services offered by Yasmina Schoueri, as detailed on the website [yasminaschoueri.com], including but not limited to:

  • Akashic Readings: Sessions for individuals, businesses, and animal companions, aimed at providing a unique perspective through the exploration of the Akashic Records.
  • Energy Healing: Support aimed at releasing emotional and energetic blockages, promoting harmony, mental clarity, and overall well-being.
  • Energy Massage: Treatment combining intuitive massage techniques for physical relaxation and gentle energetic harmonisation for inner balance.
  • Yoga: Group or private classes in Vinyasa, Hatha, or Yin/Restorative styles.
  • Gift Card: Purchase voucher issued by Yasmina Schoueri, allowing the beneficiary to choose one or more of the offered Services, up to the value of the voucher, with the option to pay the difference if the beneficiary desires an alternative service.
  • Reservation: The action by which the Client expresses their intention to receive a Service on an agreed date and time.
  • Client: Any natural or legal person who makes a Reservation for a Service or purchases a Gift Card from Yasmina Schoueri, whether for their own benefit or that of a third party.
  • Beneficiary: The natural person who actually receives the Service. The Beneficiary may be the Client themselves or another person designated by the Client (notably in the case of a Gift Card).
  • Website: The website of Yasmina Schoueri accessible at [yasminaschoueri.com], presenting information relating to the offered Services, prices, and Reservation procedures.

Article 3 – Terms and Conditions for the Provision of Services

The sole purpose of Yasmina Schoueri’s activity is the well-being of the individual, the business, or the animal companion. In accordance with current legislation, the treatments provided by Yasmina, in the absence of diagnosis and therapeutic treatment, do not in any way, either in content or objective, constitute a medical practice. These are solely well-being and relaxation techniques. Any erotic or sexual services are also expressly excluded from Yasmina Schoueri’s activity. For energy massage, the wearing of underwear is mandatory as a minimum; no nude massage will be performed. Any inappropriate behaviour towards Yasmina will be subject to legal proceedings.

Yasmina operates solely by appointment at her healing spaces and remotely. She may occasionally travel within a 10km radius from her home to the Client’s domicile, professional premises, or any public venue (event settings, trade shows, conferences, etc.) upon the Client’s acceptance of a quotation. In such cases, the Client undertakes to provide Yasmina with a space (minimum 10 m²) where the hygiene, quietness, and safety conditions are compatible with the provision of the treatment. Travel arrangements for in-home Akashic Readings will be agreed on a case-by-case basis.

Services are offered according to the schedules indicated on the homepage of the website [yasminaschoueri.com]. Yasmina Schoueri reserves the right to modify these schedules at any time.

During Energy Healing and Energy Massage sessions, Yasmina Schoueri will provide the Client with all necessary professional equipment (massage table, protective coverings, towels, massage oils, background music, etc.) and reserves the right to refuse a session in the event of questionable hygiene on the part of the Client and/or inappropriate behaviour.

Session Procedure:

  • Energy Healing and Energy Massage: The session begins with an exchange between Yasmina and the Client to assess the Client’s condition and needs in order to determine the most suitable service. Time will be allowed for the Client to settle in. The Client’s comfort and privacy will be ensured with draping and towels for massages. At the end of the session, time will be allowed for the Client to regain composure and get dressed if necessary. A review of mutual sensations will take place, and some advice may be given.
  • Remote Energy Healing: The session begins with an exchange between Yasmina and the Client to assess the Client’s condition and needs. Subsequently, the Client will be invited to lie down comfortably. Similar to an in-person session, Yasmina will connect to the Client’s energy field to provide healing and well-being energy. Once the healing is complete, there will be time for the Client to return to themselves and for an exchange about their experience.
  • Akashic Readings: The session begins with an exchange to understand the Client’s questions and intentions regarding the reading (for themselves, their business, or their animal companion). Yasmina then centres herself to access the Akashic Records. The perceived information (intuitions, images, words, sensations) is shared verbally with the Client. An interactive dialogue allows for a deeper exploration of important points. The session concludes with the closing of the Records and an exchange on the sensations and possible next steps.

Sessions include preparation, setup (where applicable), the treatment/reading/class, and the concluding exchange.

Article 4 – Contraindications and Precautions

It is essential that the Client informs Yasmina Schoueri of any medical, physical, or psychological conditions that may affect the provision of the Service. Yasmina Schoueri reserves the right to refuse or adapt a Service if she deems it necessary for the safety and well-being of the Client.

4.1 Akashic Readings:

Contraindications:

  • Individuals suffering from severe, unstable mental disorders (schizophrenia, acute phase of bipolar disorder, etc.).
  • Individuals under the influence of consciousness-altering substances (drugs, alcohol).
  • Minors without the informed consent of their legal guardians.

Precautions:

  • Individuals who are psychologically fragile or going through an emotionally difficult period are advised to exercise caution and be accompanied if necessary.
  • Akashic Readings should not replace medical, psychological, or legal advice.
4.2 Energy Healing and Energy Massage:

Contraindications (may require medical advice):

  • Fever or acute infection.
  • Unstable cardiac conditions.
  • Significant circulatory problems (phlebitis, acute phase of thrombosis).
  • Contagious skin diseases.
  • Recent fractures or injuries.
  • Recent surgical operations (less than 3 months, or longer depending on medical advice).
  • Pregnancy (first trimester or high-risk pregnancy).
  • Organ transplant with immunosuppressive treatment.
  • Cancer undergoing treatment.
  • Psychological disorders (acute phase of depression, bipolar disorder, etc.).
  • Epilepsy.
  • Severe asthma.
  • Coagulation problems.
  • Diabetes.
  • Osteoporosis.
  • Acute disc herniation.

Precautions:

  • Report any allergies to essential oils or other products used.
4.3 Yoga Classes:

Contraindications (may require medical advice):

  • Acute infections or fever.
  • Severe balance disorders.
  • Unstable cardiac conditions.
  • Uncontrolled high blood pressure.
  • Recent operations.
  • Joint problems (rheumatism, osteoarthritis).

Precautions:

  • Inform the instructor of any medical conditions.
  • Do not force postures.
  • Adapt practice to one’s level.
General Information:

This list is not exhaustive. In case of doubt, it is imperative to consult a medical professional before booking a Service.
Yasmina Schoueri reserves the right to adapt or refuse a Service if she deems it inappropriate for the Client.

Article 5 – Prices and Payment Terms

5.1 Service Prices:

The prices of the various Services offered by Yasmina Schoueri are indicated in Euros (€) on the website [yasminaschoueri.com] and can be viewed on the booking page or the dedicated price page. The prices displayed are firm and definitive, excluding specific promotional offers for which the terms of validity and application are clearly indicated.

In accordance with Article 293B of the French General Tax Code (Code Général des Impôts), Yasmina Schoueri is not subject to Value Added Tax (VAT). Consequently, the prices mentioned on the website are indicated exclusive of VAT (HT). Should Yasmina Schoueri become subject to VAT, the prices displayed on the website will be adjusted accordingly and will apply to any booking or purchase made from the date of her becoming subject to VAT.

Yasmina Schoueri reserves the right to modify her prices at any time. However, the price applicable to a Service reservation will be the price in force at the time of confirmation of the reservation by the Client. For the purchase of a Gift Card, the applicable price will be the price in force at the time of purchase.

5.2 Payment Terms:

Payment for Services and Gift Cards can be made by the following means, as specified on the website:

  • Online Payment: By credit or debit card (Visa, Mastercard, other accepted cards). Payment is secured by an encryption system. The card will be debited upon confirmation of the reservation or purchase.
  • On-site Payment: In cash, and/or by credit or debit card (Visa, Mastercard, other accepted cards), and/or via Lydia at the time of the Service.
  • Remote Payment (for remote readings and healings): Via a secure payment link, according to the terms communicated during the appointment booking. Payment may be required before the Service is provided.
5.3 Specific Conditions for Gift Cards:

Gift Cards are valid for a period of one (1) year from their date of purchase. They can be used for all Services offered by Yasmina Schoueri, up to their value. If the beneficiary chooses a Service whose price exceeds the value of the Gift Card, they will be required to pay the difference using the accepted payment methods (cf. Article 5). Gift Cards are neither exchangeable nor refundable, even in case of loss or theft.

5.4 Late Payment:

In the event of late payment, late payment penalties may be applied in accordance with the legal provisions in force.

5.5 Payment Security:

Yasmina Schoueri implements all necessary measures to ensure the security and confidentiality of bank details transmitted during online payments.

Article 6 – Reservations, Modifications, Cancellations, and Payment

6.1 Reservations:

Appointments can be made via the online booking system available on the website [yasminaschoueri.com], in person, by email, or by telephone. All necessary contact details for making an appointment are available on the website, notably via the online booking form.

Online booking is available for all Services taking place at my healing spaces and for remote Akashic Readings and Energy Healing. For sessions at the Client’s location (healings and massages), bookings are made in person, by email, or by telephone to agree on specific arrangements.

To make an online booking, the booking form must be completed following each step. The Client chooses the desired type of Service, the duration (if applicable), and their availability. Based on the defined criteria, available time slots will be proposed. The Client finalises their booking by providing their contact details and proceeding with payment if required at the time of booking.

A booking will only be considered confirmed upon receipt of the confirmation email. It is the Client’s responsibility to verify the accuracy of the information contained in this email.

To organise Yasmina Schoueri’s schedule, appointments can be made up to 24 hours before the desired time, subject to displayed availability.

6.2 Modification and Cancellation Conditions:

Modifications: The Client may modify their booking free of charge up to 12 hours before the appointment, in person, by email, or by telephone. Any modification request made within 12 hours preceding the Service may be refused, and the session will be considered due.

Cancellations: The Client may cancel their booking up to 12 hours before the appointment using the cancellation link in the confirmation or reminder email (if applicable), in person, by email, or by telephone.

General Clause: Beyond the cancellation deadlines mentioned above (except in cases of proven force majeure), the Service will be considered due and will be invoiced. This clause also applies if the Client does not appear at the agreed place and time for the session. An invoice will be issued for any booking not cancelled within the deadlines or in case of no-show.

6.3 Payment:

In-person Services (healings, massages, yoga): Payment is made on-site at the end of the session in cash, by credit or debit card (via a payment terminal accepting Visa, Mastercard, and other cards mentioned on the website), or via Lydia.

Remote Akashic Readings and Energy Healing: Payment is required before the Service is provided and is made by the means indicated in the reminder email.

Gift Cards: Payment for Gift Cards is made in full at the time of purchase according to the methods offered on the website.

6.4 Late Arrival:

Yasmina Schoueri undertakes to strictly adhere to appointment times to ensure quality service. A buffer time is scheduled between each booking to ensure optimal reception of the next Client.

The Client is requested to arrive at the time agreed upon when booking the appointment. In case of early arrival, the treatment room may not yet be ready. In case of late arrival by the Client, the duration of the session may be shortened so as not to impact subsequent appointments. Yasmina Schoueri reserves the right to refuse a Client if their lateness is such that it compromises the proper and complete provision of the Service. The session will be considered due and will be invoiced in such cases.

Article 7 – Specific Terms and Conditions for Packages

These specific terms and conditions apply to packages that may be offered for Yasmina Schoueri’s Services. The specific conditions for each type of package (number of sessions, validity period, included Services) will be clearly indicated at the time of purchase.

7.1 Personal and Non-Transferable Nature:

Packages are strictly personal and may not be transferred to any third party, whether free of charge or for consideration.

7.2 Non-Refundability:

Except in the cases expressly mentioned below, no refund, even partial, will be made for a package not used in whole or in part during its validity period.

7.3 Validity Period:

The validity period of each package is clearly indicated at the time of purchase. Once this deadline has passed, any remaining sessions will be definitively lost and cannot be carried over or refunded, unless an exceptional derogation is granted by Yasmina Schoueri.

7.4 Exceptional Carry-Over or Refund Conditions:

A carry-over of the validity period or a partial refund of the package may be considered in the following cases, subject to the presentation of appropriate supporting documents and Yasmina Schoueri’s agreement:

  • Inability of Yasmina Schoueri to Provide the Service: In the event of Yasmina Schoueri’s inability to provide the Services included in the package for a significant period of its validity.
  • Justified Medical Reason of the Client: Prolonged physical or medical incapacity of the Client, attested by a medical certificate, preventing them from benefiting from the Services for a substantial part of the package’s validity period. The decision to carry over or refund will remain at Yasmina Schoueri’s discretion and may be subject to specific conditions (e.g., deduction of sessions already used, administrative fees).
7.5 Modification of Package Terms and Conditions:

Yasmina Schoueri reserves the right to modify at any time the general terms and conditions applicable to future packages. The terms and conditions applicable to a purchased package will be those in force at the time of purchase.

Article 8 – Purchase and Use of Gift Cards

8.1 Purchase of Gift Cards:

Gift Cards can be purchased directly from Yasmina Schoueri, either via the form available on my website [yasminaschoueri.com], in person, by email, or by telephone. The Client can choose the value of the Gift Card equivalent to a treatment duration.

An electronic Gift Card (PDF format) will be sent to the Client’s email address provided during the order, within a maximum of forty-eight (48) business hours following receipt of full payment.

Payment for Gift Cards can be made by the following means if the order is placed in person: cash, credit or debit card (via a payment terminal in person or via a secure payment link for remote purchases), or Lydia. For remote purchases, payment is made via a secure payment link according to the terms communicated during the order.

8.2 Right of Withdrawal (Cooling-Off Period):

In accordance with the legislation in force regarding distance contracts, the Client has a withdrawal period of fourteen (14) days from the date of receipt of payment for the Gift Card, without having to provide reasons or incur penalties.

To exercise their right of withdrawal, the Client must notify Yasmina Schoueri of their decision in writing (for example, by email or by registered letter with acknowledgment of receipt to her professional address).

In the event of withdrawal within the aforementioned period, Yasmina Schoueri will reimburse the Client for the full amount paid, within a maximum of thirty (30) days from the date of receipt of the notification of withdrawal, using the same means of payment as that used by the Client during the purchase, unless expressly agreed otherwise by the Client for another means of reimbursement.

8.3 Terms of Use of Gift Card:

Gift Cards are personal and non-transferable. The name of the beneficiary may be indicated at the time of purchase.

Unless otherwise specified at the time of purchase, Gift Cards are valid for a period of one (1) year from their date of purchase. The expiry date will be clearly mentioned on the Gift Card.

Gift Cards can be used to pay for all or part of the price of a Service offered by Yasmina Schoueri. If the price of the chosen Service exceeds the value of the Gift Card, the beneficiary must pay the difference using the accepted payment methods (cf. Article 5). No refund, even partial, will be given if the value of the chosen Service is less than that of the Gift Card.

Booking a Service with a Gift Card can be done online, in person, by email, or by telephone, specifying the Gift Card number. The Gift Card (in electronic or printed format) must be presented at the beginning of the session.

The terms and conditions for modifying or cancelling a reservation made with a Gift Card are identical to those defined in Article 6 of these GTC.

Yasmina Schoueri shall not be held liable for the loss or theft of a Gift Card. Gift Cards are neither exchangeable for cash nor refundable (except in the case of withdrawal within the legal period).

In the event that Yasmina Schoueri is unable to provide the Service or in the case of a justified medical reason (upon presentation of a medical certificate from the beneficiary), an extension of the validity period of the Gift Card may be considered at Yasmina Schoueri’s discretion.

Article 9 – Preferential Rates and Promotional Offers

9.1 Application of Advertising Discounts:

Discounts or benefits offered within the framework of a specific advertisement apply to the standard rates in force at the time of booking or purchase, unless expressly stated otherwise in the terms and conditions of the advertising offer. These discounts cannot be combined with other promotions, sales, or preferential rates already applied.

9.2 Promotional Offers:

Yasmina Schoueri may occasionally offer promotional offers on certain Services. The specific conditions of these offers (validity period, Services concerned, terms of application, etc.) will be clearly detailed on the communication medium of the offer (website, social networks, flyers, etc.). Unless otherwise indicated, these offers cannot be combined with each other or with other discounts or preferential rates.

9.3 Specific Rates (where applicable):

Specific rates may be offered to certain categories of clients (e.g., students, seniors, groups) upon presentation of valid proof. The terms of application of these specific rates will be communicated on a case-by-case basis. These rates are generally not combinable with other promotional offers or discounts.

9.4 Modification or Withdrawal of Offers:

Yasmina Schoueri reserves the right to modify, suspend, or withdraw any promotional offer or preferential rate at any time and without prior notice. However, the terms of an offer accepted at the time of booking or purchase will remain applicable to that specific transaction.

Article 10 – Services Subject to Personalised Quotation (Businesses, Events)

These specific conditions apply to Services requiring the establishment of a personalised quotation, notably for interventions in a professional setting or during events.

10.1 Validity of the Quotation:

The quotation issued by Yasmina Schoueri is valid for a period of thirty (30) calendar days from its date of issue, unless otherwise specified on the quotation itself. After this period, the quotation will be considered null and void and will need to be reassessed if the Client still wishes to proceed with the order.

10.2 Order and Deposit:

The quotation signed by the Client, accompanied by the mention “Good for agreement” (“Bon pour accord”), and these GTC signed by the Client constitute agreement and a definitive order form. Validation of the order is conditional upon receipt by Yasmina Schoueri of a deposit representing thirty percent (30%) of the total amount indicated on the quotation. Payment of this deposit may be made in cash, by credit or debit card (via a payment terminal or secure payment link), by bank transfer, or by Lydia, according to the terms specified on the quotation. The provision of the Service will only commence upon receipt of the deposit.

10.3 Payment of the Balance:

Unless an additional payment period has been expressly agreed in writing between the Parties and indicated on the invoice, the balance of the payment is due in full and must be settled within a maximum of seven (7) business days following the date of issue of the invoice. Payment of the balance may be made using the same methods as the deposit (cash, credit or debit card, bank transfer, Lydia).

10.4 Late Payment Penalties:

In the event of late payment of the balance by the agreed due date, late payment penalties will be applied in accordance with the legal provisions in force. Unless specifically agreed otherwise, the interest rate for late payment penalties will be equal to three times the legal interest rate. These penalties will be payable automatically and without the need for a reminder, from the first day of delay. In addition, a fixed indemnity for recovery costs of forty (40) Euros will be automatically due by the Client in the event of late payment.

10.5 Conditions of Cancellation or Postponement by the Client:

Any request for postponement or cancellation of the Service by the Client must be notified in writing (email or registered letter with acknowledgment of receipt) to Yasmina Schoueri within the following deadlines:

  • Postponement: Any request for postponement must reach Yasmina Schoueri at least seven (7) business days before the scheduled date of the Service. Postponement will be subject to Yasmina Schoueri’s availability and may incur additional costs if the initial conditions of the quotation are modified.
  • Cancellation:
    In the event of cancellation notified between seven (7) and four (4) business days before the scheduled date, Yasmina Schoueri shall be entitled to invoice, as compensation, fifty percent (50%) of the total amount of the quotation, before deduction of the deposit paid.
    In the event of cancellation notified within three (3) business days preceding the scheduled date, or in the event of on-site cancellation or cancellation the day before, Yasmina Schoueri shall be entitled to invoice, as compensation, seventy-five percent (75%) of the total amount of the quotation, before deduction of the deposit paid.
    In the event of cancellation on the day of the Service or no-show by the Client, the compensation shall be one hundred percent (100%) of the total amount of the quotation.
    The deposit paid will remain acquired by Yasmina Schoueri as cancellation compensation, unless otherwise agreed in writing.
10.6 Cancellation by Yasmina Schoueri:

In the event of cancellation of the Service on Yasmina Schoueri’s initiative and if no replacement date is agreed upon within a reasonable period, the latter will reimburse the Client for the full amount of the deposit paid within a maximum of eight (8) business days. Yasmina Schoueri shall not be held liable for any indirect damages suffered by the Client as a result of such cancellation.

Article 11 – Incapacity to Work

11.1 Temporary Incapacity:

In the event of temporary physical incapacity of Yasmina Schoueri due to illness, accident, or any other event preventing her from providing her Services, Yasmina Schoueri undertakes to inform the Client as soon as reasonably practicable. She reserves the right to propose new dates for the execution of the Services initially agreed upon, in consultation with the Client and subject to her availability. The Client shall not be entitled to demand any compensatory indemnity from Yasmina Schoueri as a result of such postponement.

11.2 Permanent Incapacity:

In the event of permanent physical incapacity of Yasmina Schoueri making it impossible to continue her activity, any current contract or commitment with Yasmina Schoueri’s Clients shall be terminated automatically. In such cases, Yasmina Schoueri undertakes to reimburse the Client for any deposits received for Services not performed, within a maximum of eight (8) business days following notification of the termination. No compensatory indemnity may be claimed from Yasmina Schoueri by the Client as a result of such termination due to permanent incapacity.

11.3 Force Majeure:

Yasmina Schoueri’s obligations under these GTC shall be suspended in the event of the occurrence of a force majeure event as defined by French case law, including but not limited to: natural disaster, fire, general strike, governmental restrictions, epidemic, pandemic, etc., which would prevent the normal performance of the Services. In this event, Yasmina Schoueri will endeavour to find an amicable solution with the Client (postponement of the Service, reimbursement of the deposit for Services not performed).

Article 12 – Applicable Law and Jurisdiction

These General Terms and Conditions of Sale are governed by French law.

12.1 Amicable Settlement of Disputes:

In the event of any dispute or disagreement relating to the interpretation, execution, or validity of these GTC, the Parties undertake to seek an amicable solution as a priority. The Client undertakes to send a written complaint to Yasmina Schoueri by registered letter with acknowledgment of receipt to her professional address or by email, clearly stating the subject of the dispute and the desired solutions. Yasmina Schoueri will endeavour to respond to this complaint within a reasonable period of thirty (30) days from its receipt.

In the event that this attempt at amicable resolution fails, the Parties may resort to mediation with an accredited mediator. The costs of mediation will be shared equally between the Parties, unless otherwise agreed.

12.2 Competent Jurisdiction:

In the absence of an amicable resolution under the conditions provided above, any dispute between Yasmina Schoueri and a consumer Client shall be subject to the jurisdiction of the competent French courts under the rules of ordinary law (place of residence of the consumer or place of performance of the Service).

For any dispute with a professional Client (business), exclusive jurisdiction is hereby conferred upon the courts of Paris, notwithstanding plurality of defendants or third-party claims, even for urgent or conservatory proceedings in summary judgment or by petition.

Article 13 – Civil and Professional Liability

13.1 General Limitation of Liability:

Yasmina Schoueri’s liability is limited to the proper execution of her obligations as defined in these GTC. Her liability shall not extend to indirect, consequential, or incidental damages, loss of profits, loss of data, or any other damage not foreseeable at the time of the conclusion of the contract between Yasmina Schoueri and the Client.

13.2 Liability for Information Provided by the Client:

It is expressly stipulated that Yasmina Schoueri shall not be held liable for any damages, injuries, or negative consequences resulting directly or indirectly from inaccurate, incomplete, or delayed information provided by the Client, particularly concerning their state of health, contraindications (cf. Article 4), specific needs, or information necessary for the performance of the Service (for example, for business or animal readings).

13.3 Specific Liability for Akashic Readings:

The Client acknowledges and agrees that Akashic Readings constitute guidance and perspectives and are in no way absolute predictions, or medical, psychological, financial, or legal advice. Yasmina Schoueri shall not be held liable for decisions made or actions taken by the Client based on the information communicated during the reading. Yasmina Schoueri’s liability is limited to the provision of the information perceived during the reading.

13.4 Specific Liability for Energy Healing and Energy Massage:

Energy Healing and Energy Massage are well-being and relaxation techniques. They do not in any way substitute for professional medical advice or treatment. Yasmina Schoueri shall not be held liable for any aggravation of a pre-existing medical condition or the occurrence of health problems following a session if the Client has not correctly informed Yasmina Schoueri of their contraindications (cf. Article 4).

13.5 Specific Liability for Yoga Classes:

The Client is responsible for their own safety and well-being during yoga classes. Yasmina Schoueri shall not be held liable for injuries or bodily harm occurring during a class if the Client has not followed safety instructions, adapted their practice to their level, or informed of any physical or medical limitations.

13.6 Professional Civil Liability Insurance:

Yasmina Schoueri attests to having taken out professional civil liability insurance with Axa under policy number 11288582504, in order to cover bodily injury, material damage, and consequential financial loss that may be caused to Clients in the context of her professional activity, subject to the exclusions and limits of guarantee of the said policy.

Article 14 – Pre-contractual Information

Pursuant to Articles L.111-1 et seq. of the French Consumer Code (Code de la consommation), the Client acknowledges having been provided with, in a legible and comprehensible manner, prior to the placement of their order and the conclusion of the contract, these GTC and all required pre-contractual information, including but not limited to the following:

  • The essential characteristics of the services offered by Yasmina Schoueri.
  • The price of the services and the terms of payment.
  • The terms and conditions for booking, performance, and modification of the services.
  • Information pertaining to the identity of Yasmina Schoueri (trading name, geographical address, telephone and electronic contact details).
  • Information regarding legal warranties (if applicable to certain aspects of the services, such as the sale of associated goods).
  • The existence and modalities for exercising the right of withdrawal (if applicable to services sold at a distance).
  • The procedures for the settlement of disputes, including the possibility of recourse to mediation.

The act of placing an order implies the Client’s full and unreserved acceptance of these GTC and acknowledgement of having taken cognizance of the pre-contractual information.

Article 15 – Right of Withdrawal (for Services Sold at a Distance to Consumers)

In accordance with Articles L.221-18 et seq. of the French Consumer Code, the Consumer Client has a period of fourteen (14) days to exercise their right of withdrawal from a contract concluded at a distance, without having to state reasons or bear costs other than those provided for in Articles L.221-23 to L.221-25 of the same Code. The withdrawal period shall commence from the day of the conclusion of the service provision contract.

To exercise the right of withdrawal, the Consumer Client must notify Yasmina Schoueri of their decision to withdraw before the expiry of the aforementioned period by means of an unequivocal statement expressing their intention to withdraw. Such notification may be sent by:

  • Email to the following address: yasmina.schoueri@mail.com.
  • Using the standard withdrawal form set out in Annex 1 of these GTC (optional, but recommended).

Should the Consumer Client wish the performance of the services to commence before the end of the withdrawal period, they must make an express request to Yasmina Schoueri. If the Consumer Client exercises their right of withdrawal from a service provision contract the performance of which has commenced, at their express request, before the end of the withdrawal period, the Consumer Client shall be liable to pay Yasmina Schoueri an amount corresponding to the service provided until the communication of their decision to withdraw, proportional to the total price of the agreed service.

Article 16 – Legal Guarantees (if Sale of Associated Goods)

Pursuant to the provisions of the French Consumer Code relating to the legal guarantee of conformity (Articles L.217-1 et seq.) and the guarantee against hidden defects (Articles 1641 et seq. of the French Civil Code [Code civil]), Yasmina Schoueri is liable for defects in conformity of the goods to the contract and for hidden defects in the goods sold.

The Consumer Client has a period of two (2) years from the delivery of the goods to take action under the legal guarantee of conformity. They may choose between repair or replacement of the goods, subject to the cost conditions provided for in Article L.217-9 of the French Consumer Code. During the six (6) months following the delivery of the goods, the lack of conformity is presumed to have existed at the time of delivery, unless proven otherwise.  

The Consumer Client may also decide to take action under the guarantee against hidden defects within the meaning of Article 1641 of the French Civil Code. In this case, they have the choice between rescission of the sale or a reduction in the sale price in accordance with Article 1644 of the French Civil Code.  

For any claim under the legal guarantees, the Consumer Client must contact Yasmina Schoueri in accordance with the procedures indicated in Article 19.

Given that the services offered by Yasmina Schoueri primarily consist of intellectual and well-being services, the legal guarantees of conformity and against hidden defects provided for in the French Consumer Code and the French Civil Code do not directly apply. In the event that goods are offered for sale on an ancillary basis, the legal provisions in force regarding guarantees shall apply in accordance with Articles L.217-1 et seq. of the French Consumer Code and Articles 1641 et seq. of the French Civil Code.

Article 17 – Dispute Resolution

Amicable Settlement: In accordance with Article 12 of these GTC, in the event of a dispute, the Parties undertake to seek an amicable solution as a priority.

Consumer Dispute Mediation: In accordance with Articles L.612-1 et seq. of the French Consumer Code, the Consumer Client has the right to have recourse, free of charge, to a consumer ombudsman with a view to the amicable resolution of the dispute opposing them to Yasmina Schoueri.

The competent ombudsman for Yasmina Schoueri is CNPM Médiation Consommation, 27 avenue de la Libération, 42400 Saint-Chamond, France, telephone number: +33 4 77 42 10 58.

The Consumer Client may refer the matter to the ombudsman via their website: [https://www.cnpm-mediation-consommation.eu/].

Recourse to the ombudsman is free of charge for the consumer. The mediation process is confidential.

Jurisdiction: Failing an amicable agreement or recourse to mediation, the rules of territorial jurisdiction shall apply in accordance with Article 12 of these GTC.

Information relating to the protection of personal data is detailed in our Privacy Policy, which forms an integral part of these GTC.
